The Los Angeles County Sheriff and the Los Angeles County Counsel (attorneys) have sent us a cease and desist notice regarding this item, claiming trademark infringement. We know that the Los Angeles County Sheriff and the County Counsel (attorneys) are both public agencies and that the Sheriffs logo and star are public domain items. However to avoid further issues with these narrow minded entities, we NO LONGER HAVE THIS ITEM AVAILABLE FOR SALE. Part of the cease and desist notice includes a mention that these decals for model cars are "likely to cause consumer confusion with the LASD's use of its intellectual property as to source. Moreover, your unauthorized use of LASD's intellectual property is likely to mislead the public into mistakenly believing that your product has been sponsored, endorsed, or is otherwise affiliated with LASD." Who in their right mind would believe that decals used for model cars would be endorsed or sponsored by the department, and moreover who would care? It is simply sad that the department and county counsel have chosen to use these heavy handed tactics. The department should be honored that a collector or builder of model cars would want to make a LASD car or add one to their collection. Having a model in one's collection would be much better publicity for the department than this shameful cease and desist notice. So, for you certain lawyers and departmental folks out there, as requested, THIS ITEM IS NOT AVAILABLE FOR SALE. It is removed from availability on January 13, 2009. None of these decals for model cars are in stock, and no more will be ordered or carried in inventory. |
